Dear Representative,

As parent in the Olathe School District it has come to my attention that a convicted child molester has moved into the local elementary area.  This man was charged and convicted of sexually assaulting a 13-year-old girl in his own home.  He served his time for this horrendous offense according to the courts that convicted him but then he moved to Kansas where the convicted child molesters’ restrictions of residence are different.  He served only 120 days in prison for his offense. This man comes from a state, which has both Jessica’s Law and Megan’s law.  He is from a state where he was not allowed to live within 2,000 feet of parks and schools in that state but now he lives in a state that does not have that limitation. I understand Kansas to have a law to restrict officials from the government can not pass a law restricting where sex offenders can live.  What about at least restricting that a sex offender can not live across the street from an elementary school?  How about a law to notify all parents that a sex offender lives in the neighborhood.  Something beyond the KBI sex offender’s site.  I know Kansas government officials do not have the authority to keep sexual offenders from living near schools, but as parents we wants to know that a sex offender is living near our school.  

FACTS about this specific predator
:

     *Lives 208 feet from an elementary school and 1584 feet from a park.
     *Was charged with PC 288(a) – Lewd Acts w/ Minor and PC 243.4(e)(1) – Sexual 
            Battery of a 13 year old female.
     *Was convicted of an offense of molesting a child.
     *The state of his conviction has laws preventing sexual predators from living
          within 2000 feet of a school.  The state of his residence does not have such a law.

Please take the time now to review this problem.  Kansas needs a law that notifies parents when a child molester moves into their neighborhood as well as residential limitations with distance to places that children frequent.  Let’s keep Olathe Schools safe.

Our family moved to Olathe 2 years ago after living in another Kansas town for most of our lives. We chose Olathe because of its reputation for high performing schools, close community feel, and safe environment for children. Recently we discovered something disturbing in our neighborhood. Our neighbors and friends notified us that Name Deleted, after his conviction of child molestation and completion of a short 120 days in a California jail has moved in to our neighborhood. Name Deleted place of residence is not only across from Name Deleted Elementary it is yards away from Name Deleted Park and the highly traveled Indian Creek Trail. While California has laws against convicted child molesters living next to schools and parks Kansas does not unless a judge specifies it. The California judge could not have the foresight to place stipulations on where he can live when he was sentenced in a state where there is legislation in place to protect their children from offenders. Because of Kansas’s lax laws, Name Deleted and other convicted molesters can move to Kansas and live wherever they please putting our children in danger and placing the burden on where these people live on all Kansas families.  

     Our question to you is why is Kansas allowing convicted child molesters to live in close proximity to the children they prey on? Most other states, including Missouri, Oklahoma, Nebraska, Iowa, and Arkansas have laws in regards to keeping molesters away from schools and parks while Kansas does not. Kansas legislators and elected officials should be embarrassed. Convicted molesters can flock to Kansas and live within a short distance of the children they victimize. If Kansas does not pass legislation to end the free reign of offenders, they will come here in droves because of our neglectful child protection laws. This will inevitably cause decent law-bidding tax payers to move to other states that provide legislative protection for their children.
     While we understand that these people need to live somewhere, Kansas is making it easy for them to find other victims. My neighbors that unfortunately live next to Name Deleted are putting their house on the market in order to protect their children. They’re safety has been compromised and they are forced to leave the neighborhood that they intended on raising their children in. When word gets around that a child molester lives directly across from the school and park watching their kids from his driveway, there will be more people leaving our neighborhood, possibly to Missouri where they have laws to protect their children. This specific offender doesn’t only affect my family, he also impacts the City Council Members who live in our school district as well as anyone who chooses to let their child use the park, walk to Name Deleted School, or Name Deleted High School via the Indian Creek Trail.
     We appeal to you as a family held hostage by a child molester in our own neighborhood, please work on legislation to keep convicted molesters away from our kids. If you are not in a position to work on legislation please pass on as much information that you can so we can find a resolution to keeping our children safe. We do have one last question. How would you feel knowing that your child, grandchild, niece, or nephew while at school or the park is being ogled by a child molester sitting in a lawn chair from the comfort of his own driveway?

I'm writing to you as a concerned and outraged mother of four young children who live in your community.  Very recently a man by the name of
(name deleted for privacy) moved in across the cul-de-sac from my family.  (Name deleted) was convicted in the state of California in January of 2010 for child molestation.  After a short 120 days in jail, he moved here to the state of Kansas.  I have recently learned that unlike California, who has very strict regulations on where convicted child molesters can live, Kansas has no restrictions, unless specified by a judge.  Consequently, not only is (Name deleted) living across the street from my four young children, he is living just feet from (Name deleted) Elementary where my, and all the other neighborhood children, attend school.  (Name deleted) is able to watch neighborhood children as they walk to and from school, as well as while they play at recess, from the comfort of his own home.    To put it in a nutshell, (Name deleted)'s right to live anywhere he would like in the state of Kansas, has put my family, as well as all our neighborhood children at risk.  Statistics overwhelmingly show that sex offenders re offend over and over again.  Kansas' lack of legislation to restrict these convicted criminals will cause Kansas to appeal to such offenders and make them flock to our state, therefore worsening this problem for law abiding citizens. To protect law abiding citizens quality of life, Kansas needs to regulate where convicted child molesters can live, Kansas should provide constant monitoring of  such criminals and child molesters should also be required to notify neighbors of their status.  The rights that Kansas awards to (Name deleted), who has been convicted of committing a heinous crime against a CHILD, puts his rights ahead of tax paying, law abiding citizens.   We have worked so hard to give our children the way of life and opportunities this community has to offer.  When we moved here four years ago from Texas, we specifically chose a house in a school zone assuming that Kansas offered the same protection for children from convicted sex offenders as Texas and most other states.  We never would have dreamed there was a place that allows sex offenders the option to live directly across the street from schools, daycares, parks ect..  In the blink of an eye, our high quality of life has been taken away.  We no longer feel safe letting our children go our into the cul-de-sac to run and play, for fear of the convicted child molester  living across from us.  Our family and other families like us, hope that you as our ____________________________ will do something about this.   My husband and I have already met with our Realtor because we refuse to allow our children to live in such close proximity to a convicted child molester.  We have shed many tears because we wanted to raise our children in this home and community that we love so much.  I hope you see the injustice that Kansas' liberal policies toward convicted child molesters causes in the lives of your upstanding, law abiding community members.  I would love to hear your explanation concerning our situation and why a convicted child molester's rights and way of life comes before ours.  Thank you for your time.   Sincerely, (deleted), (deleted), (deleted)  (12 years), (deleted) (8 years),(deleted) (7 years),(deleted) (5 years)    Contact info: (deleted for privacy)
